Terms of Service

These Terms of Service ("Terms") govern your access to and use of engsteady.com, the EngSteady mobile app, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated under the trading name EngSteady ("EngSteady", "we", "us"). You can reach us at [email protected].

2. The Service

EngSteady provides English-language practice tests, AI-assisted grading, and progress tracking. The Service is provided "as is" and may evolve over time as we add, change, or remove features.

3. Eligibility

You must be at least 16 years old to use the Service. By using EngSteady you confirm that you meet this requirement and that the information you provide is accurate.

The Service is built for adults and older teenagers preparing for English proficiency exams. It is not directed to children. We do not knowingly allow anyone under 16 to create an account, and if we learn that an account belongs to someone under 16 we will close it and delete the associated data. A parent or guardian who believes their child has created an account can contact us at [email protected] and we will remove it.

6. Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service and its content for your own exam preparation only. This licence does not transfer any ownership to you, and it ends automatically if your account is closed, suspended, or terminated.

Every other use is reserved. In particular, the licence does not permit you to reproduce, republish, redistribute, publicly display, frame, mirror, sell, sublicense, or create derivative works from any part of the Service.

7. Our content

Tests, questions, prompts, reading passages, images, audio, feedback text, branding, and software are owned by EngSteady or its licensors and are protected by copyright and other intellectual property laws. All reading passages, exam items, and accompanying material are original works created for the Service. Publication names, mastheads, bylines, and dates that appear within test materials are fictional and are used only to set the scene for an exam question.

We may enforce these restrictions by any technical means available to us, including rate limiting, blocking IP addresses and networks, and suspending or terminating accounts. We may do so without notice and without refund.

9. No use for artificial intelligence or machine learning

This restriction is separate from, and additional to, section 8. You may not use any part of the Service, and no part of the Service may be used by anyone, to:

This restriction applies to every method of collection, automated or manual, and applies to content obtained through an authorized account just as it does to content obtained without one. No licence to our content for these purposes is granted by these Terms, by the availability of the Service, or by any technical means of access.

10. Reservation of rights for text and data mining

EngSteady expressly reserves all rights to carry out text and data mining in relation to all content made available through the Service, including for the purposes described in Article 4 of Directive (EU) 2019/790 on copyright in the Digital Single Market and any equivalent or successor provision in any jurisdiction.

No text and data mining exception or limitation may be relied upon in respect of our content. This reservation is made expressly here and in machine-readable form through the robots.txt file and the HTTP response headers served with the Service.

11. Your content

You retain ownership of the answers and recordings you submit ("Your Content"). You grant EngSteady a non-exclusive, worldwide license to host, process, and display Your Content solely to operate, secure, and improve the Service (for example, to grade your test, show you a review, and analyze quality of grading).

You confirm that Your Content is yours to submit and does not infringe anyone else's rights.

12. AI grading

Open-ended writing and speaking responses are graded with the help of automated systems (including Google Gemini). Scores are estimates and are not an official certification of language proficiency. We do not guarantee that any score you receive corresponds to a score on any third-party exam, and scores must not be relied on as a prediction of any exam result, admission decision, or other outcome.

Grading is automated but is not a decision that produces legal effects concerning you. If you would like a human to look at a score, email [email protected].

13. No affiliation with testing organizations

MET and Michigan English Test are trademarks of Michigan Language Assessment. EngSteady is an independent practice service and is not affiliated with, endorsed by, sponsored by, or approved by Michigan Language Assessment or any other testing or certifying organization. Any reference to a third-party exam is made only to describe the format that our practice materials follow.

EngSteady does not issue certificates, official scores, or any credential recognized by a testing organization, university, employer, or immigration authority.

14. Copyright complaints

We respect copyright. If you believe content on the Service infringes a copyright you own or represent, send a notice to [email protected] including:

We will review valid notices and remove or disable access to infringing material. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address. We terminate the accounts of repeat infringers.

15. Termination

15.1 By you

You may stop using the Service at any time. You can cancel your subscription from your account, and you can delete your account as described in our Privacy Policy.

15.2 By us, for breach

We may suspend or terminate your account immediately and without notice if we reasonably determine that you have breached these Terms, in particular sections 8, 9, or 10, or that your account poses a security, legal, or financial risk to us or to other users. Examples include scraping or bulk extraction, using our content to train or evaluate an AI or machine learning system, circumventing rate limits or access controls, sharing or reselling your account, and payment fraud or chargeback abuse.

If we terminate your account under this section, no refund is due, any unused credits are forfeited, and we may decline to provide the Service to you again. We may also block the IP addresses and networks involved.

15.3 By us, for any other reason

We may also stop providing the Service to you for any other reason, or for no reason, by giving notice to the email address on your account.

If we end your account under this section 15.3 and you have a paid subscription, we will refund the unused part of your current billing period, calculated pro rata by day from the date your access ends to the end of that period, and we will cancel any further renewals. The refund goes to your original payment method. It is calculated on time remaining, not on how many credits or tests you used. This refund is an exception to the non-refundable rule in section 5, and it does not apply where we terminate for breach under section 15.2.

15.4 Effect of termination

When your account ends, your licence under section 6 ends immediately, your access to the Service stops, and any remaining credits lapse without cash value. Your data is handled as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including sections 7 through 11, 16 through 19, and 21 through 22.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold EngSteady harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms. This does not apply to claims caused by our own breach of these Terms or our negligence, and it does not limit any rights you have as a consumer under mandatory law.

17. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that grading will be accurate in every case.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot be excluded or limited under the law that applies to you as a consumer.

18. Limitation of liability

To the maximum extent permitted by law, EngSteady will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or in connection with the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the event giving rise to the claim or USD 100.

Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.

19. Time limit for claims

To the extent permitted by law, any claim relating to the Service must be brought within one year after the event giving rise to it. Claims brought after that period are permanently barred. Where mandatory law in your place of residence provides a longer period, that period applies instead.

20. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. When we make a material change we will update the effective date above, communicate the change through the Service or by email, and ask you to accept the updated Terms the next time you sign in. Non-material changes take effect when posted.

21. Governing law and where disputes are resolved

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in King County, Washington, and you and EngSteady each consent to personal jurisdiction there. Either of us may still bring an individual claim in small claims court if it qualifies.

If you live outside the United States, this section does not deprive you of the protection of any mandatory consumer protection law of your country of residence, or of any right you have under that law to bring proceedings in the courts of the place where you live. Consumer law in the European Union, the United Kingdom, and many other countries gives you those rights regardless of what these Terms say.
